Introduction
You are joining the Entheosacrament Association, d/b/a Plant Magic Collective, a PRIVATE MINISTERIAL ASSOCIATION (“PMA”) protected by the 1st Amendment of the U.S. Constitution, the Religious Freedom Restoration Act, and Colorado state laws related to the Natural Medicine Health Act under Proposition 122. This PMA is dedicated to the propagation of the movement and the free exercise of religious liberties, particularly those related to Natural Law, Sovereignty, and entheogenic sacramental practices. By joining, you are choosing to exercise your religious beliefs and share resources, documents, and advice related to these principles.
Purpose and Mission
The purpose of the PMA is to provide general organization of services for churches and religious people who share practices, values, and resources and cooperate in the facilitation of individual sacrament. The mission of the PMA is to reduce barriers to the reception of sacrament, to engage in harm reduction and education, to promote responsible best practices among members and member churches, to reduce the burden of provisions among member churches, to engage in benevolent enterprises, and to enable members to collectively tithe member churches in an egalitarian fashion.
Services
The PMA will engage the religious, religious communities, and cooperative religious groups in sharing resources, best practices, educational content, and ancillary services around harm reduction, sacrament, and responsible practices, among those religious organizations and men and women of similar values. The PMA members may share services, information, and resources commensurate with the operation of the PMA, and cooperate, share, or give in support of augmenting the educational content or facilitation of religious liberties reflecting the values of the Association. These support services include preparation and integration work around natural medicines, coaching, educational information, education about growing natural medicines, harm reduction information, supported use, or other related services. Natural Medicines are those plants and fungi now legal under Colorado state law under the Natural Medicine Health Act (“NMHA”), also known as Proposition 122.
Premium Membership Fees, Benefits, and Termination
Membership (both free and premium) is granted in the sole discretion of the PMA. Premium Membership fees are a monthly recurring fee, payable on the first of the month to cover: (1) bona fide harm reduction service and bona fide support services; (2) access to educational resources developed by practitioners and licensed professionals; (3) responsible conduct guidelines and assistance, (4) best practices, (5) and other ethical guidelines. A benefit of membership is the sharing among members without any remuneration of a personal possession amount of sacrament of up to a 30 day supply. Any payment related to your membership is not for sacrament, but solely for the above listed support services or related services or charges such as overhead, PMA administration, educational services, support services, or other related fees. All members acknowledge and understand that no one associated with the PMA is a formally licensed psychedelic facilitator by the state of Colorado.
Either party may terminate the agreement at any time. Free Members and Premium Members may terminate the agreement and fees via emailed link, or via the PMA’s webpage. Termination of agreement will not result in a refund of any membership fees previously paid.
Confidentiality and Privacy
Any and all information or data collected by the Associations, its Board, or it Members shall be limited only to that which is required to reasonably operate the Association’s services to its Members. Any and all such information on the Association, its members, or Board is strictly confidential and not to be shared with any man, woman, 3rd party, association member, nor officer or Board member unless required for facilitating the services of the Association to its members. Where any disclosure is required by law or court order, the federally protected constitutional rights to religious liberties, freedom of association, and private contracts, shall be sought by the Association to the fullest extent allowed by applicable laws. This includes, but is not limited to, personally identifiable information of Association members, strategic plans, financial information, and minutes of board meetings.
Indemnification
Each Member attests that they are fully informed as to known and inherent risks of participating in the PMA’s activities, including the use and sharing of natural medicines. Members agree to forever release, indemnify, and hold harmless the PMA from any and all claims, counterclaims, damages, defenses, setoffs, recoupments, debts, demands, causes of action, suits, obligations, losses, costs, expenses, and liabilities of any nature whatsoever, in law or in equity, whether known or unknown, fixed or contingent, including but not limited to those arising from the activities of the PMA and the use of natural medicines. Members agree not to sue the PMA, or any of the PMA’s principals, contractors, or agents, and waive any right of recovery, whether known or unknown, that Member may have to bring a claim or a lawsuit against PMA for any personal injury, death, damage to personal property or other injury arising from the services and use of natural medicines, whether arising from a theory of any tort, including negligence, or any other theory in law or equity. This release shall inure to the benefit of any member of the PMA’s family, spouse, heirs, assigns, attorneys and personal representatives, specifically including Meaghan Richmond personally, and the Plant Magic Café, or the building housing the PMA. This release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
Mediation/Arbitration
Prior to initiating any action under this Agreement, the Parties agree to engage in mediation to resolve any disputes. If mediation is unsuccessful, any dispute, claim, interpretation, controversy, or issues of public policy arising out of relating to this Agreement, including the determination of the scope or applicability of this Section, will be determined exclusively by mandatory binding arbitration held in Denver, Colorado, and will be governed exclusively by the Colorado Revised Arbitration Act, §§ 13-22-201, et seq., C.R.S. (the “CRAA”). The Parties waive (i) any right of removal to the United States federal courts and (ii) any right in the United States federal courts to compel arbitration, to confirm any arbitration award or order, or to seek any aid or assistance of any kind.
Restrictions
Member is prohibited from, and expressly agrees Member will not:
- Engage in any criminal act related to natural medicine, such as the illegal sale or commercialization of any natural medicine.
- Engaging in any act prohibited act, such as public consumption of natural medicines, operating a motor vehicle impaired by natural medicines, possession of Natural Medicines in a public building, school, or jail, the provision of natural medicines to minors, or the endangerment or harm to any third person.
- Member agrees they have obtained independent medical clearance to determine if the religious use of natural medicine sacraments are safe for them.
