In November, there was an outpouring of concerns raised against the Colorado Department of Regulatory Affairs (DORA) last minute change in Rule to effectively ban at-home facilitation as an authorized location under the state's Natural Health Medicine Act.
However, in December DORA released new proposed rules around at-home facilitation and microdosing, and unfortunately, none of the feedback about at-home facilitation was incorporated. The proposed rules can be found here. These rules do relax the duration requirement for someone taking under 2mg of psilocin from three hours to one hour and change the facilitator ratio to 8-1 for such low doses. The rules also BAN at-home facilitation except in cases of palliative care and where the facilitator has 100 hours of experience at a healing center and works for a healing center. The proposed rules also ban group facilitation outside of a licensed healing center.
BANNING AT-HOME FACILITATION
Previously, facilitators could independently facilitate natural medicine services at participant homes with no requirement of a qualifying condition, subject to some additional safety requirements. The Natural Medicine Advisory Board even recommended expanding this option to include other locations where natural medicine services can take place outside of Healing Centers. SB 23-290 directs DORA to promulgate rules concerning βparameters for a facilitator to provide and supervise natural medicine services at an authorized location that is not a healing center's licensed premises, including a health-care facility or a private residence.β It is absolutely within the intention of Proposition 122 and SB 23-290 to allow for safe access to other authorized locations outside of a licensed healing center.
Nonetheless, the state has continued to propose substantially limiting at-home facilitation to only those persons who are receiving palliative care services.
This is a problematic Rule for many reasons:
- There are many situations and various physical and mental health conditions beyond palliative care in which at-home facilitation may be a better fit for participant needs.
- This change presents a significant barrier for access in rural parts of the state, where we know it will be cost-prohibitive in many communities to establish a healing center.
- This change presents a major equity issue, increasing the costs for being able to access a facilitator's services for low income individuals and others with financial, geographic, or other practical barriers to access.
- This change requires facilitators to work on behalf of a Healing Center - negating their independence and driving up participant costs.
- This change further pushes participants and facilitators into relying on Personal Use and so-called "underground" services, creating less safety for all involved.
We invite you to submit a written comment (email your comments to dora_dpo_rulemaking@state.co.us) and register to testify on 1/6/25 at 1:30pm at the rule making hearing held via webinar, telling DORA how these rules will drastically limit access to natural medicine services and cause unintended negative consequences for many people and communities.
At-home facilitation is safe, supports access and equity, and should be allowed for our diverse communities across Colorado.
